RULES:
The First prize for the
GREAT FOOTAGE CONTEST is $250.00 cash and $250.00 in
prizes.
Please EDIT the footage
if possible or give us the timecode where the footage
takes place on the tape. KEEP A COPY FOR YOURSELF!
Tapes will be reviewed on an ongoing basis. See below
for information on deadlines.
Entrants should include their return address and telephone
number and a brief written description of the clips
being submitted.
All submissions shall become the sole property of Producer.
Entrants should include a $3.00 handling fee per tape,
in U.S. money order, if they wish Producer to return
their video(s), which will be done on a rolling basis
during 2004 - 2005. Producer reserves the right to destroy
all videos for which return was not requested at the
time of submission. Producer is not responsible for
lost, damaged or misdirected tapes under any circumstances.
Please keep a copy of your submission.
All home video formats are acceptable (VHS, 8MM, digital
video) and must be shot with a consumer camera. NOTE:
MINI DV is our choice of format! If you can, please
send the footage on a MINI DV tape. Home videos
transferred to DVD or CD-ROM will be accepted for initial
screening and review, however the original tape must
be provided to Producer upon request in order to meet
eligibility and broadcast requirements. If not so provided,
the submitted video will not be eligible for inclusion
in the program. 8MM film transferred to videotape is
also accepted.
Videos that purport to be spontaneous must be so, or
entrant must explicitly disclose the circumstances of
the taping at time of entry.
Producer reserves the right to edit and/or alter any
submission.
Videos must be exclusive to THUNDERSTRUCK FILMS and
BIG SKY X-TREME SNOWMOBILING PRODUCTIONS.
Decisions of the judges as to all contest matters are
final and nonappealable. All submissions are subject
to the terms of these rules and all entrants agree to
be bound by these rules and the decisions of the judges.
Producer reserves the right to amend these rules at
any time.
ELIGIBILITY
Employees and riders of THUNDERSTRUCK FILMS and anyone
involved in the production, or administration of the
contest, as well as immediate family/same household
members of anyone so employed or engaged are not eligible
for prize awards.
Persons under 18 may enter but written parental consent
will be required before their entries will be considered.
Entrants whose clips are chosen for inclusion in a film
must sign a Release and Indemnity in the form presented
attesting, among other things, to the fact that they
are the rightful owners of the submitted clips and that
the clip may be submitted and broadcast without obtaining
permission from or making any payment to any third party.
All persons appearing in the clips must sign consent
forms and/or releases (which shall grant to Producer
the right to use such person's name, voice and likeness)
before the submission can be eligible for prize awards.
Parent or guardian must sign the consent/release form
for minors. Failure to provide requested releases and/or
consents will result in disqualification of entrant.
These release and/or consent forms will be provided
by the Producer. Notwithstanding the foregoing, the
submission of a videotape constitutes the submitter's
permission to use the videotape (and the name, voice
and likeness of the submitter) in and in connection
with the program and all exploitations thereof, including,
without limitation, advertising and promotion and, further,
constitutes the submitter's representation that all
necessary consents and permissions therefor have been
obtained.
Each submission must be solely the original work of
entrant.
Each entrant represents that his/her submission does
not infringe on any third party's copyrighted material,
trademark or other intellectual property rights.
By submitting your videotape each entrant agrees to
release, discharge, and hold harmless THUNDERSTRUCK
FILMS and BIG SKY X-TREME SNOWMOBILING PRODUCTIONS and
their respective officers, directors, employees, agents
and representatives from any claim or liability arising
from or related to submission of the entry, participation
in this contest, appearance on the film, and/or acceptance
or use of any prize.
Each entrant agrees that his/her submission shall be
governed by and construed under and in accordance with
the laws of the State of Montana applicable to contracts
entered into and wholly performed therein. Each entrant
consents and agrees to the exclusive jurisdiction of
the federal and state courts of the State of Montana,
located in the County of Lewis and Clark.
JUDGING CRITERIA
Videos/footage/material will be judged for inclusion
in films and for prizes on the basis of their humor
and/or uniqueness.
PRIZES
The First prize for the GREAT FOOTAGE CONTEST is $100.00
cash and $200.00 in prizes.
Prizes will be awarded to the person(s) submitting the
videotape, provided they certify and establish to Producer's
satisfaction that they are the owner(s) of the videotape
and further provided that they have complied with the
official rules and sign all necessary forms as determined
by Producer.
Winners are solely responsible for all federal, state
and local taxes.
CONTEST DEADLINES
The first contest deadline date for the 2004 - 2005
season is JULY 8, 2005. The second contest deadline
is JULY 10, 2006.
At Producers' sole option, any video may be retained
and considered for use and reuse, and used and reused,
in any subsequent edition of the film, or any other
program or ancillary use in any media.
RELEASES
All entrants must sign all consent forms, general releases
and other authorizations in the form provided by Producer
or be eliminated from consideration. Releases will include,
among other things, a statement that the videos are
the exclusive property of the entrant(s) and that the
events purported to be spontaneous were in fact spontaneous
and not staged.
Releases must be obtained from all identifiable persons
depicted in videos. Parent or guardian must sign the
consent/release form for minors.

OTHER LEGAL STUFF
Any footage/material you send to THUNDERSTRUCK
FILMS including photos, film, tape, or the like is,
and will be treated as, nonconfidential and non-proprietary.
Anything you send can be used by THUNDERSTRUCK FILMS
or its sponsors for any purpose, including, but not
limited to, reproduction, disclosure, transmission,
publication, broadcast and posting on the internet.
Furthermore, THUNDERSTRUCK FILMS is free to use any
ideas, concepts, know-how, or techniques contained in
any communication/footage/material you send for any
purpose whatsoever including, but not limited to, developing,
manufacturing and marketing products using such material.
Images of people or places displayed
on sent footage are either the property of, or used
with permission by, THUNDERSTRUCK FILMS. The use of
this material by you, or anyone else authorized by you
on or before November 30, 2005 for any other purpose
is prohibited unless specifically permitted by these
Terms and Conditions or by specific permission provided
by THUNDERSTRUCK FILMS (This prevents you from sending
your footage to other sled video companies and having
the same footage show up in our competitor's films!).
Any unauthorized use of the material may violate copyright
laws, trademark laws, the laws of privacy and publicity
and communications regulations and statutes.
Under no circumstances will THUNDERSTRUCK FILMS be
liable for any damages (including, but not limited to,
special, incidental, consequential or indirect damages
either to person or equipment) arising out of the filming
or shooting of said material or footage, even if THUNDERSTRUCK
FILMS has been advised of the possibility of such damages.
